Where the purchaser places Better Packaging Co. products on the market in any European Union Member State, the purchaser accepts and acknowledges that they are the 'producer' of that packaging under Regulation (EU) 2025/40 (the EU Packaging and Packaging Waste Regulation, PPWR) and are solely responsible for all obligations arising from that role, including but not limited to: registration in applicable national producer registers; enrolment in and payment of fees to Extended Producer Responsibility (EPR) schemes; issuance of a Declaration of Conformity; and compliance with all applicable substance, recyclability, labelling, and minimisation requirements.
Better Packaging Co. makes no representation that its products meet all PPWR requirements for all applications or markets. Product-specific compliance documentation is available on request. It is the purchaser's responsibility to determine the suitability of any product for use in the EU market and to obtain independent legal advice regarding their specific obligations under PPWR.
US Regulatory Compliance - Compostable Packaging
Better Packaging Co. supplies certified compostable packaging for use in markets where compostable claims are permitted. It is the sole responsibility of the purchaser to ensure that any packaging purchased from Better Packaging Co. is used in compliance with the laws and regulations of the jurisdiction in which it is distributed, or used.
From 30 June 2027, California's Assembly Bill 1201 (AB 1201) prohibits compostability and biodegradability claims - including certification marks - on poly mailers, poly garment bags, and similar flexible plastic packaging sold in California. Better Packaging Co. makes no representation that its compostable packaging products comply with AB 1201 or any other US state or federal packaging regulation, and accepts no liability for any regulatory non-compliance arising from the use or distribution of compostable packaging in any US jurisdiction.
Purchasers intending to sell, distribute, or ship products in compostable packaging to customers in California or elsewhere in the United States are strongly advised to seek independent legal advice regarding their obligations under applicable US packaging regulations before doing so.
